Terms of Service

1.Summary

These terms are an agreement between you and Halloween AI ("we", "us") for using the website at halloween-ai.net and its portrait and video tools (the "Service"). By using the Service, you agree to these terms and to our Privacy Policy.

2.Your account

• You must be at least 18 years old.
• Keep your sign-in details secure. You are responsible for activity on your account.
• One person per account. Do not create accounts to collect free credits.

3.Credits and payments

• Generating a portrait or video uses credits. The cost is shown before you generate.
• New accounts may receive a small number of free credits. Free credits have no cash value.
• Credit packs are one-time purchases. Pack credits expire 365 days after purchase.
• Subscriptions renew automatically each month or year until you cancel. Monthly plans add credits each month, and they expire when that billing month ends. Yearly plans also add credits each month; they build up during the paid year and expire together when that year ends.
• You can cancel a subscription at any time from Billing in Settings. Cancelling stops future renewals. You keep the credits you already have until they expire.
• Prices are shown in US dollars and may not include taxes. We may change prices for future purchases.
• If a generation fails on our side, the credits are returned to your balance.

4.Your photos and results

You keep ownership of the photos you upload and the portraits and videos you create. You give us permission to store, process and display them only as needed to provide the Service to you. This permission ends when the content is deleted.

You are responsible for having the right to use every photo you upload. Images are watermarked previews until you remove the watermark, which costs 1 credit per image. Subscribers download images without a watermark.

AI results can be unexpected. A portrait may not look exactly like you, and it may not match the example images. Do not rely on results for identification or any official purpose.

5.What you may not do

Do not use the Service to upload or create:

• images of anyone without their consent, or images meant to harass, threaten or impersonate a real person;
• sexual or nude content, or any content involving minors in a sexual or harmful way;
• content that is illegal, hateful, or that promotes violence;
• deepfakes intended to deceive, defame or commit fraud;
• content that infringes someone else's copyright, trademark or other rights.

Also do not try to break, overload, scrape or reverse engineer the Service, get around its limits or filters, or resell it without our permission.

We may block content, remove results and suspend or close accounts that break these rules.

6.Our service

The Service, its design, software and example images belong to us or our licensors. We may change, pause or stop features at any time. We will try to give notice of significant changes.

The Service is provided "as is" and "as available". We do not promise that it will be uninterrupted, error free, or that results will meet your expectations.

7.Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental or consequential losses, or for loss of data or profits. Our total liability for any claim about the Service is limited to the amount you paid us in the 12 months before the claim.

Nothing in these terms limits rights you have under consumer protection laws that cannot be waived.

8.Ending your use

You can stop using the Service and delete your account in Settings at any time. We may suspend or close your account if you break these terms. When an account is closed, its photos and results are deleted and unused credits are lost, except where our Refund Policy or the law says otherwise.

9.Changes and governing law

We may update these terms. If we make significant changes, we will update the date above and, where appropriate, tell you by email or on the site. Continuing to use the Service after a change means you accept the new terms.

These terms are governed by the laws of the place where Halloween AI is operated, without regard to conflict of law rules. This does not remove any protection you have under the consumer laws of the country where you live.
